IMPORTANT NOTICE

These Terms and Conditions (“Terms”) are the general terms set out on this website. These Terms apply to purchases made through this website and, to the extent applicable, to other purchases from Icon House Limited. In the event of any inconsistency between these Terms and any sales contract, purchase agreement, quotation or other written agreement separately entered into between Icon House Limited and a customer in respect of any product, the terms of such signed agreement shall prevail.

These Terms do not constitute a sales contract. A binding contract is only formed in accordance with Clause 3 below (in respect of website orders) or upon the execution of a separate written agreement.

1. DEFINITIONS

“Customer” or “you” means the individual or entity purchasing products from the Company.

“Company”, “we”, “our” means Icon House Limited, including the operation under the brand “Buona Tana”.

“Products” means any products and goods of Icon House Limited, including but not limited to mattresses, pillows, bed frames, electric hydraulic storage bed frames, pet beds and accessories.

“Website” means https://www.iconhouse.net/ and any related subdomains.

2. PRODUCT DESCRIPTIONS AND PRICING

2.1 We endeavor to ensure that all product descriptions, dimensions, specifications and other information on this website are accurate. Due to screen display differences, product images and colors may differ from the actual products. If you believe that any product does not correspond in material respects to its description, please contact us and your statutory rights will be applicable.

2.2 All prices are displayed in Hong Kong Dollars (HKD) and are updated from time to time. The price applicable to your order is the price displayed at the time of order confirmation.

2.3 In the event of a genuine pricing error and the correct price is higher, the Company will contact you before processing to allow you to choose to confirm the order at the correct price or cancel and receive a full refund. If the correct price is lower, the Company will charge the lower price.

2.4 Prices do not include delivery charges (which are separately stated at checkout) and any applicable customs duties or import taxes. Customers outside Hong Kong are responsible for local taxes and duties.

3. ORDERS AND PAYMENT

3.1 Orders placed through this website constitute an offer to purchase. A binding contract is only formed when the Company sends an order confirmation to your email address.

3.2 We take reasonable steps to ensure that products displayed on this website are available for purchase. In exceptional circumstances, the Company may need to cancel a confirmed order, including:

(a) the product becomes unavailable after the order is placed due to circumstances beyond the Company’s reasonable control;

(b) a genuine pricing error occurs (the Company will contact you before cancellation);

(d) payment fails.

In the event of cancellation, a full refund will be issued within reasonable time.

3.3 The Company will not accept payment for products which it does not intend or could not reasonably be expected to supply.

3.4 Unless otherwise agreed, full payment is required at the time of ordering. We accept major credit/debit cards and other payment methods displayed at checkout. All online transactions are processed by third-party payment processors with encryption. The Company does not store your complete card details and will never request payment information via email or telephone.

3.5 By placing an order, you confirm that you are at least eighteen years of age (or have parental/guardian consent) and that all information provided is accurate.

4. DELIVERY AND SERVICES

4.1 The Company will perform delivery and any related services (including assembly or installation services provided) in accordance with the Supply of Services (Implied Terms) Ordinance (Cap. 457) with reasonable care and skill and within a reasonable time.

4.2 Orders are typically processed within 7 to 14 working days after payment. Actual delivery time may vary depending on product availability, delivery location and other factors. If there is likely to be a significant delay in delivery, we will notify you and you may cancel the order and receive a full refund.

4.3 Delivery within Hong Kong is by third-party courier or logistics transport company to the designated address, unless otherwise agreed. Residential, remote areas or special deliveries may incur additional charges and will be communicated before you place your order.

4.4 Risk of loss or damage to the products transfers to you upon delivery. Please inspect the products upon receipt and report any issues within the timeframe set out in Section 5 below.

4.5 The Company shall not be liable for delays in delivery caused by events genuinely beyond the Company’s reasonable control, including natural disasters, severe weather, epidemics or pandemics declared by competent authorities, government orders or sanctions, or industrial action. We will notify you of such delays as soon as reasonably practicable.

5. RETURNS AND EXCHANGES

5.1 All returns and exchanges are subject to prior approval. Before returning any product, please contact the Company by email at [email protected].

5.2 Returns or exchanges will only be accepted in the following circumstances:

(a) the product is damaged or defective upon delivery;

(b) the product delivered does not correspond to the product ordered;

(d) defective or incorrectly delivered products; or

(d) sale or discounted products may still be returned if these products are defective or are not corresponding to the product descriptions.

5.3 Please notify the Company within 7 days of receipt, providing the order number, relevant photographs or videos, and a description of the problem.

5.4 After the Company approves the return and exchange, [the Company will arrange for a third-party courier or logistics transport company to collect the returned product as soon as possible]. [Returned products must be in their original condition with all packaging, labels and accessories intact.]

5.5 For exchanges approved by the Company, the Company will provide a replacement free of charge, subject to stock availability. If the same product is not in stock, the Company will offer an alternative product of equal value or a full refund, at your choice.

5.6 The following circumstances generally do not qualify for returns:

(a) circumstances other than those set out in Section 5.2 above.

(b) products that have been used, soiled, washed or altered;

(d) beyond the timeframe set out in Section 5.3 above;

(e) customized or made-to-order products;

(f) complimentary gifts, samples or promotional items.

5.7 For products approved for return and exchange by the Company, unless otherwise specifically stated by the Company to you, return shipping costs are borne by the Company.

5.8 Refunds will be processed within 30 working days after inspection and refunded to your original payment method. If the reason for return is a defective, incorrectly delivered or not as described product, the original delivery charges may be refunded.

5.9 Nothing in this section limits your statutory rights under the Sale of Goods Ordinance (Cap. 26).

6. LIMITATION OF LIABILITY

6.1 Personal Injury and Death

Nothing in these Terms excludes or limits the Company’s liability for death or personal injury caused by negligence of itself or its employees, agents or subcontractors, nor for fraud or fraudulent misrepresentation.

6.2 Property Damage

Subject to Section 6.1, if any product causes damage to your property due to a defect, the Company’s liability is limited to the reasonable cost of repair or replacement of the damaged property, up to a maximum of HKD [50,000] per incident.

6.3 Other Losses

Subject to Sections 6.1 and 6.2, the Company’s aggregate liability to you for all other losses arising out of or in connection with these Terms (whether based on contract, tort (including negligence), breach of statutory duty or otherwise) is limited to the purchase price paid by you for the product giving rise to the claim.

6.4 Excluded Losses

Subject to Sections 6.1 and 6.2, the Company shall not be liable for any loss of profits, loss of business, loss of anticipated savings or any indirect or consequential losses, except for losses that were reasonably foreseeable by both parties at the time of contracting.

6.5 Preservation of Statutory Rights

Nothing in this section affects your statutory rights under the Sale of Goods Ordinance (Cap. 26), the Supply of Services (Implied Terms) Ordinance (Cap. 457) or any other applicable law. In the event of any conflict between these Terms and your statutory rights, your statutory rights shall prevail.

6.6 To the extent permitted by law and subject to the above provisions, the Company is relieved of liability for losses that are not reasonably foreseeable consequences of breach of these Terms or the duty of care owed to you.

7. PRODUCT SAFETY INFORMATION

7.1 The Company is committed to supplying products that meet the statutory safety requirements of the Consumer Goods Safety Ordinance (Cap. 456) and (in respect of electrical products) the Electrical Products (Safety) Regulation (Cap. 406G).

7.2 Before using any product, please read all accompanying safety warnings, instructions for use and care labels. In particular:

(a) Electric hydraulic storage bed frames: Products contain electrical and mechanical components. Follow all installation, operation and maintenance instructions. Do not operate if any component appears damaged. Ensure that hands and objects are kept away from moving parts during operation.

(b) Bed frames: Maximum weight capacity is as indicated for each model. Do not exceed the specified weight limits. Assemble correctly according to instructions.

(c) Mattresses, bedding, pet beds and related accessories and supplies: Follow care and cleaning instructions. Keep away from open flames. Keep dry and well ventilated.

8. PRIVACY POLICY

8.1 The Company is committed to protecting your personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. This policy explains how the Company collects, uses, stores and protects your data.

8.2 The Company may collect your:

(a) identity and contact information, including name, address, email, telephone number;

(b) financial information, including payment card details (processed by third-party payment processors; the Company does not store full card numbers);

(d) technical and usage data, including IP address, browser type, pages browsed, device information; and

(e) third-party data, including information you provide about gift recipients or other persons (you confirm that you have obtained their consent).

8.3 We use your data to:

(a) process and deliver your orders;

(b) communicate with you regarding orders and accounts;

(d) improve this website and services;

(e) detect and prevent fraud; and

(f) comply with legal obligations.

8.4 The Company may share your data with:

(a) third-party courier or logistics transport companies for delivery;

(b) third-party payment processors (such as VISA, PayPal);

(d) government or law enforcement agencies (if legally required).

8.5 The Company will not sell or transfer your data to third parties for their marketing purposes without your explicit consent.

8.6 The Company protects your data with encrypted secure third-party payment processing and access control measures. However, internet transmission is not absolutely secure and the Company cannot guarantee absolute security of data.

9. GENERAL TERMS

9.1 This website and its content (including the “Buona Tana” brand) are protected by intellectual property rights belonging to the Company or its licensors.

9.2 The Company updates these Terms from time to time. Material changes will be notified on this website. The terms in effect at the time you place an order apply to that order.

9.3 If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable or severed, and the remaining provisions will remain in effect.

9.4 These Terms, together with the Company’s Privacy Policy, apply to purchases from the Company, but are always subject to any separately executed sales contract or written agreement, which shall prevail in the event of any inconsistency.

9.5 Subject to Important Notice above, these Terms constitute the entire agreement between the parties and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter. Each party acknowledges that in entering into these Terms it does not rely on, and shall have no remedies in respect of, any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms. Each party agrees that it shall have no claim for innocent or negligent misrepresentation based on any statement in these Terms.

9.6 These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes are subject to the non-exclusive jurisdiction of the Hong Kong courts.
